"There are five boxes to use in the defense of Liberty: The Soap Box, the Mail Box, the Ballot Box, the Jury Box, and the Ammunition Box. Please use them in that order."

For some time, many people have been getting more and more irate with the federal government’s encroachment on liberties here in the United States. From talk show hosts to podcasters to bloggers, many people have been on their Soapboxes in an effort to defend liberty.

Because of them, millions of Americans have used the Mailbox to write, email, fax, and call their elected representatives. Millions of us told them “NO!” on various issues. And they ignored us.

So we went to the Ballot Box and voted them out, and we told their replacements “NO!” on various issues. And they ignored us. We told them ”NO!” with bailout after bailout, and they ignored us. We told them ”NO!” on cap-and-tax, and they ignored us. We’re telling them ”NO!” on nationalized healthcare… and they are still ignoring us.

Now there are rumblings of dissent. People in this country are tired of being ignored. We are tired of politicians wasting our time and violating our trust. We ‘re getting mad as hell. And already, some people are quietly saying to close friends, “We might be getting close to a time where we need to do whatever we have to do to take this country back, if you know what I’m saying.” What they’re talking about is armed insurrection, and they need to stop that line of thinking.

Yes, they’re mad. Yes, they’re fed up. Yes, they’re ready to reach for the Ammunition Box. But there is one Box that We the People haven’t used yet: the Jury Box.

Enshrined in Article 3 Section 2 of the Constitution of the United States is the right to a trial by jury. And the jury has the right and the power to nullify the law. It is the final check and balance. And we must use it before it is too late. The Jury Box is a way that politicians can neither stop, prevent, nor do anything about. A way for We the People to wrest control back from the tyrannical “leaders” in Washington.

Juries have the power — and the right — to judge not just the facts of the case, but also the law itself and its just application. Juries can vote to acquit even if the accused admitted breaking the law. Unfortunately, jurors are prevented from hearing about jury nullification by judges who purposely give improper instruction to their juries, or who muzzle defense attorneys and defendants from informing the jury of their right to jury nullification. This flies in the face of the purpose and intent of trial by jury, and ignores the stated intentions of the Founders:

“But we all know that permanent judges acquire an Esprit de corps; that being known, they are liable to be tempted by bribery; that they are misled by favor, by relationship, by a spirit of party, by a devotion to the executive or legislative power… It is in the power, therefore of the juries… to judge the law as well as the fact.” ? — Thomas Jefferson, 1789

“Jurors should acquit, even against the judge’s instruction…if exercising their judgement with discretion and honesty they have a clear conviction that the charge of the court is wrong.” ? — Alexander Hamilton, 1804

But we cannot simply ignore their laws and wait to go to court. Since the majority of the potential jury pool is unaware of the right and responsibility of juries to judge both the facts of the case and the law itself, it is likely that right now it would be difficult if not impossible to win a case using jury nullification as a defense strategy. So what do we do?

First, we must begin to spread awareness. We must inform potential jurors and incoming juries of their rights and responsibilities to just both the law and the facts of the case. Then, once enough people have been educated, then and only then can we begin a campaign of civil disobedience. Imagine:

  • “You want to fine me for using incandescent lightbulbs? NO. Take me to court, and I want a trial by jury!”
  • “You want to tax my company for providing top-notch healthcare for my employees? NO. Take me to court, and I want a trial by jury!”
  • “You want to take my home as part of eminent domain? NO. Take me to court, and I want a trial by jury!”
  • “You want to prevent my company from drilling for oil on land my company owns? NO. Take me to court, and I want a trial by jury! 
  • “You want to tax my company for carbon emissions? We won’t pay them. NO. Take me to court, and I want a trial by jury!”
  • “You want to force me to trade in my car, buy government healthcare, or turn down my thermostat in the winter? NO, NO, and NO! Take me to court, and I want a trial by jury!”

We do not want to ever see the Ammunition Box used to defend our liberties, and the Jury Box is our last chance to avert it.
